Name Of Plan:
The name of the pension plan hereunder shall be the "Michigan
Upper Peninsula International Brotherhood of Electrical Workers Pension Plan".
Purpose:
The Plan has been established to provide qualified electrical
workers with a source of retirement income in addition to other sources of
retirement income available to them. The Plan is to be funded by contributions
from electrical contractor employers plus contributions from the Participating
Locals on behalf of their qualified emmployees.
Plan History:
The Plan was initially installed effective June 1, 1978 with
Locals No. 19, 219, 979, 1070 and 1251 as the initial participating locals. The
Plan has been periodically amended since its original effective date and is
further amended and completely restated to comply with the provisions of the Tax
Reform Act of 1986 and other recent legislation, effective as of June 1, 1989.
As of June 1, 1989, the participating locals are Local 219, Local 979, and Local
1070.
Effective Date:
The original effective date of the Michigan Upper Peninsula
International Brotherhood of Electrical Workers Pension Plan is June 1, 1978.
The effective date of the Plan's amendment and restatement is June 1, 1989.
Construction and Applicable Law:
The Plan is intended to meet the requirements for
qualification under the Internal Revenue Code. The Plan is also intended to be
in full compliance with applicable requirements of the Employee Retirement
Income Security Act. The Plan shall be administered and construed consistent
with said intent. It shall also be construed and administered according to the
laws of the State of Michigan to the extent that such laws are not preempted by
the laws of the United States. All references herein to the "Internal Revenue
Code" or the "Code" are to the Internal Revenue Code of 1986, as from time to
time amended, together with any regulations, interpretations or decisions
thereunder. All references herein to the "Employee Retirement Income Security
Act" or "ERISA" are to the Employee Retirement Income Security Act of 1974, as
from time to time amended, together with any regulations, interpretations or
decisions thereunder.
